Terms of Service

ForkOut has a free plan and a paid subscription, ForkOut Pro. What each plan includes may change over time.

• Billing: Pro is an auto-renewing subscription sold through Apple’s App Store and charged to your Apple ID. Prices are shown in the app before you buy and may vary by country or region.
• Renewal: Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the current period ends.
• Cancelling: Manage or cancel in your Apple ID subscription settings. You keep Pro until the end of the current period. Deleting your ForkOut account doesn’t cancel your subscription.
• Refunds: Apple handles refunds under its own policies. ForkOut can’t issue refunds for App Store purchases.
• Offers: If ForkOut offers a free trial or introductory price, its terms are shown before you buy. Any unused part of a free trial ends when you buy a subscription.

You must be at least 13 years old to use ForkOut. If you are under 18, you represent that you have permission from a parent or guardian. You are responsible for ensuring your use complies with applicable laws.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and notify me promptly at support@forkout.app if you suspect unauthorized access. You may request account deletion as described in the Privacy Policy.

You agree not to:

• Use ForkOut for any unlawful purpose or in violation of these Terms.
• Attempt to access, probe, or disrupt the Service’s systems or other users’ accounts.
• Scrape, reverse engineer, or misuse the Service or third-party data it displays.
• Submit content that is abusive, harassing, infringing, or otherwise harmful.
• Misrepresent your identity or affiliation.
• Upload photos you don’t have the right to share, or that show other people’s personal information without their permission.

Access may be suspended or terminated if I reasonably believe you have violated these Terms or pose a risk to the Service or other users.

ForkOut uses artificial intelligence (including Otto, the in-app assistant) to suggest meals, recipes, and restaurants. These suggestions are for informational and entertainment purposes only. They are not medical, nutritional, or dietary advice. AI-generated content may be incomplete, outdated, or inaccurate. Nutrition estimates, including those from photos, are approximate.

Always verify allergen information, ingredients, and suitability for your health needs directly with restaurants, recipes, or qualified professionals before relying on any recommendation. You use ForkOut’s suggestions at your own discretion and risk.

ForkOut integrates third-party data and services (such as restaurant listings, recipes, and maps). I do not control and am not responsible for third-party content, availability, pricing, hours, or policies. Your use of third-party services may be subject to their separate terms.

ForkOut and its branding, software, and content (excluding third-party materials and your own submissions) are owned by me or my licensors. You are granted a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. See the License page for details.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the Service will be uninterrupted, error-free, or that recommendations will meet your expectations.

To the maximum extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. My total liability for any claim relating to the Service is limited to the greater of the amount you paid for ForkOut in the 12 months before the claim or USD $100.

Some jurisdictions do not allow certain limitations; in those cases, my liability is limited to the fullest extent permitted by law.

You agree to indemnify and hold me harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

If you downloaded ForkOut from Apple’s App Store:

• These Terms are between you and me, not Apple. Apple isn’t responsible for ForkOut or its content.
• Apple has no obligation to provide maintenance or support for ForkOut.
• If ForkOut fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation.
• Apple isn’t responsible for claims relating to ForkOut, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims.
• You confirm you’re not in a country under a U.S. government embargo and aren’t on a U.S. government list of prohibited or restricted parties.
• You must follow any third-party terms that apply when you use ForkOut, such as your mobile carrier’s.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Where these Terms are silent, Apple’s Standard EULA applies.

I may modify, suspend, or discontinue any part of ForkOut at any time. I may also update these Terms. When material changes are made, the “Last updated” date will be revised. Continued use after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles, and any disputes will be subject to the courts located in Japan, unless applicable mandatory law in your place of residence provides otherwise.
